Constitution

Preamble

We, the students of Marietta College, in order to exemplify the Seven Core Values of Marietta College and to promote the democratic process, do hereby establish this Constitution of the Marietta College Student Senate.

Article I. Name

The name of the student government organization shall be the Marietta College Student Senate.

Article II. Purpose and Intent

The purpose of the Marietta College Student Senate is to provide a channel through which the opinions, views, and actions of the students at Marietta College may become positive contributions toward the policies of Marietta College and to offer financial assistance to organizations for the betterment of the student body and the college as a whole.

  • 1.1. Serve as the official representative group of the student body to College administration, staff, and faculty, and other agencies in matters pertaining to the student body.
  • 1.2. Initiate and respond to proposals deemed beneficial to the overall welfare of the student body.
  • 1.3. Serve as a liaison in the coordination and support of activities of other student organizations.
  • 1.4. Receive and investigate student complaints and problems and work toward their satisfactory resolution.
  • 1.5. Promote greater communication and cooperation between the faculty, staff, administration, and students of Marietta College.
  • 1.6. Protect the rights and freedoms of the student body to the best of its ability.

Article III. Membership

click to expandSection 1. Executive Officers
  1. Number and Title
    The executive officers of the Marietta College Student Senate shall be the President, the Vice President, the Treasurer, and the Secretary.
  2. Term
    1. The term of the office for each of the executive officer shall be one (1) year in length.
    2. Their terms shall begin with their installation at the first meeting of the Student Senate following the Executive Officer elections, occurring the first week of April, as per Article V, Section 2 of the Bylaws.
    3. These officers shall be eligible for re-election and appointment.
  3. Election
    The regular election of the President, the Vice President, and the Treasurer shall be held during the academic year preceding their term of office. Nominations and campus elections shall be held according to regulations set forth in the Bylaws.
  4. Appointment
    1. The Secretary shall be appointed by the President, Vice President, and Treasurer of Student Senate after an application and interview process.
  5. Vacancies
    1. In the event that the President of the Student Senate is or becomes unable to fulfill his/her duties, the Vice President of the Student Senate shall automatically become President. A special student body election shall be held within three (3) weeks of the Vice President's elevation to elect a new Vice President.
    2. In the event of a vacancy in the office of the Vice President, the Student Senate shall appoint a temporary Vice President until such time as a new election can be held to fill the vacancy. This election shall occur within three (3) weeks of the vacancy.
    3. In the event of a vacancy in the office of Treasurer, the Student Senate shall appoint a temporary Treasurer until such time as a new election can be held to fill the vacancy. This election shall occur within three (3) weeks of the vacancy.
    4. In the event of a vacancy in the office of Secretary, the Student Senate shall refer to the appointment process within three (3) weeks.
  6. Limitations
    1. Executive Officers must have a minimum grade point average (GPA) of 2.50 on a 4.00 scale.
    2. Executive Officers must be in good standing with Marietta College.
    3. Applicants that meet the previously state requirements may run for any position regardless of class standing, with the exception of President, for which the applicant must be a rising Junior or rising Senior.
click to expandSection 2. Voting Members Elected by the Student Body
  1. Number and Title
    There shall be four (4) per class (Freshman, Sophomore, Junior, and Senior), totaling sixteen (16) in number, with the title of Class Representative.
  2. Term
    1. The length of the office of Class Representative shall be one (1) year in length.
    2. For upperclassmen (Sophomore through Senior), their term shall begin at the first meeting of the Student Senate following the Representative Elections, occurring the week before finals as per Article V, section B of the Bylaws.
    3. For Freshman Representatives, their term shall begin at the first meeting following the Freshman Representative Elections, occurring no later than the third (3rd) week of the Fall Semester, as per Article V, section B of the Bylaws.
    4. All Class Representatives are eligible for re-election to Student Senate and for appointment.
  3. Election
    1. The election of the Upperclassmen Representatives shall be held in the academic year preceding their term of office.
    2. The election of Freshman Representatives shall be held in the same academic year as their term of office.
    3. All nominations and campus elections shall be held according to the regulations established in the Bylaws.
    4. The four (4) students with the most votes shall be the Class Representatives.
  4. Vacancies and Absences
    1. All Class Representatives are allowed two (2) unfilled absences per semester.
    2. If a substitute is sent, the substitute must be a constituent of the Class Representative they are substituting.
    3. Tardiness of fifteen (15) minutes or more shall result in an unfilled absence.
    4. IIf a Representative collects two (2) absences, they will be asked to meet with the Executive Board to discuss their absences.
    5. If a Representative collects three (3) or more absences within a given semester, the issue will be brought to the attention of the full Senate, which may issue sanctions against the offending Representative, from warnings to removal of seat.
    6. If a seat becomes vacant, a special election can be held to fill the seat or the seat can be closed until the beginning of the following semester.
click to expandSection 3. Advisors
  1. Number and Title
    The Student Senate shall have two (2) advisors: one administrative advisor and one faculty advisor.
  2. Term
    1. The term of office for the administrative and faculty advisors shall be one (1) year in length.
    2. These advisors shall be eligible for re-appointment.
  3. Selection
    1. The recommendation of both faculty and administrative advisors will be made by the Executive Board of the Student Senate and presented to the full Student Senate.
    2. Two-thirds majority vote of the full Student Senate is needed for ratification.
    3. The advisors shall take membership upon ratification, taking place no later than the last week of April.
  4. Vacancies
    1. In the event that the faculty or administrative advisor is unable to fulfill his/her duties, another advisor will be selected within two (2) weeks.
    2. The advisor shall be selected according to the procedure previously outlined in this Constitution.
click to expandSection 4. Parliamentarian
  1. Number and Title
    There shall be one ex officio member of the Student Senate, with the title of Parliamentarian.
  2. Term
    The length of the term of the Parliamentarian shall be one (1) academic year in length, following the year of their appointment.
  3. Limitations
    The Parliamentarian may not be already be a member of Student Senate during his/her term.
  4. Appointment
    1. Student(s) wishing to take on the role of Parliamentarian must submit an application to the Student Senate Executive Board.
    2. The Executive Board will appoint a Parliamentarian that must be ratified with a 2/3 vote of the full Student Senate.
    3. Elections shall take place at the following meeting with the members of Student Senate voting.
  5. Vacancies
    In the event of a vacancy in the position, the appointment process shall be used to fill the remaining term of the position.

Article IV. Powers and Duties

The members of the Marietta College Student Senate shall have the following powers:

 

  1. The President shall:
    1. Preside at all meetings of the Student Senate as a non-voting member unless in the case of a tie, and at all meetings of the student body called by Student Senate.
    2. Maintain relations with the College faculty and with the College administration.
    3. Serve ex officio as a member of all Student Senate committees without a vote.
    4. Represent the student body at ceremonial functions.
    5. Chair the Student Senate Campus Concerns Committee.
  2. The Vice President shall:
    1. Attend all meetings of the Student Senate as a voting member.
    2. Preside at all meetings of the Student Senate as a non-voting member in the absence of the President.
    3. Perform all other duties and responsibilities of the President during the President's absence or incapacity or when requested to do so by the President.
    4. Succeed to the office of President as provided in Article III, Section 1, Part 5, Letter a
    5. Be responsible for reviewing appointments to the Student Senate's various boards and committee representatives.
    6. Be responsible for informing the applicants of appointments to various boards and committees.
    7. Work in conjunction with the President on duties necessary to administer the Student Senate's functions, committees, and staff.
    8. Maintain communication between the various boards and committees.
    9. Be responsible for planning and coordinating all Senior Week activities with the assistance of the Senior Week Committee.
    10. Perform all other duties appropriate to this office as specified in this Constitution and Bylaws.
  3. The Treasurer shall:
    1. Attend all meetings of the Student Senate as a voting member.
    2. Keep all financial records of and certify all expenditures from the student body active and reserve accounts.
    3. Render complete monthly financial statements to the Student Senate concerning the status of the student body active and reserve accounts.
    4. Maintain communication with the financial officers of the various student organizations financed through the Student Senate.
    5. Chair the Appropriations Committee of the Student Senate.
    6. Turn over all files and financial records to the newly elected Student Senate Treasurer.
    7. Perform all other duties appropriate to this office as specified in this Constitution and its Bylaws.
    8. Present Appropriation recommendations to Student Senate for action.
  4. The Secretary shall:
    1. Attend all meetings of the Student Senate as a non-voting member.
    2. Take attendance at every meeting.
    3. Be responsible for recording and distributing minutes every week.
    4. Maintain all avenues of communication between Student Senate and the College community.
    5. Chair the Communications Committee of the Student Senate.
    6. Perform all other duties appropriate to this office as specified in this Constitution and Bylaws.
  5. The Parliamentarian shall:
    1. Be appointed by the Student Senate Executive Board and ratified with an absolute majority vote.
    2. Preside at all meetings of the Student Senate as a non-voting member.
    3. Have expert knowledge on Robert’s Rules of Order and bring forth knowledge to the Student Senate when a question arises about parliamentary procedure.
    4. Count any secret ballot votes taken during a meeting of the Student Senate.
    5. Maintain relations with the College administration, faculty, and student body.
    6. Perform all other duties appropriate to this office as specified in this Constitution and its Bylaws.
    7. Run all student body elections and hold Student Senate Representatives responsible for any sanctions that may arise.
    8. Be present at the counting of the votes for all student body elections.
  6. Honoraria
    1. The President of the Student Senate shall receive an amount equal to 1.6% of the current year budget of the Student Senate.
    2. The Vice President of the Student Senate shall receive an amount equal to 1.2% of the current year budget of the Student Senate.
    3. The Treasurer of the Student Senate shall receive an amount equal to 1.2% of the current year budget of the Student Senate.
    4. The Secretary of the Student Senate shall receive an amount equal to 0.50% of the current year budget of the Student Senate.
click to expandSection 2. Duties
  1. The Marietta College Student Senate shall have the following duties:
    1. Discuss in open assembly any student activities, changes, or recommendations affecting the student body.
    2. Appoint, by an absolute majority, all student representatives to any legislative, judicial, and administrative boards involved in communal government according to the procedures set forth in their Bylaws, after due notice is given to the student body.
    3. Have the authority to create committees and to appoint committee members and a chair when deemed necessary. Committee membership shall be open to all full-time undergraduate students at Marietta College.
    4. Have the power of budgeting and allocating all funds in the Student Senate active and reserve accounts for its own use.
    5. Communicate to the student body any recommendations, appointments, directives, etc. made by the Student Senate.
    6. Determine and govern the number and kind of college wide student elections.
    7. The power to rescind any of its appointments by a two-thirds vote of the Student Senate.

Article V. Ratification

Ratification by an absolute majority of the Marietta College Student Body shall be sufficient for the adoption of this Constitution. This Constitution shall supersede any previous Constitutions of the Marietta College Student Body. All elections held under previous constitutions shall be considered valid under this Constitution. All appointments, directives, etc., made by the Student Body Executive Board shall remain valid so long as they do not conflict with this Constitution. All bylaws existing under previous Constitutions shall be in effect to the extent that such bylaws are not in contradiction with or included in this Constitution.

Article VI. Amendments

  1. The Student Senate, whenever two-thirds of its members deem it necessary, or the student body, by petition of not less than 10 percent of its members shall propose amendments to this Constitution.
  2. All proposed amendments to this Constitution shall be valid to all intents and purposes when ratified by an absolute majority of the Marietta College Student Body.
